A registered Maharashtra marriage certificate is the main document for a spouse visa, but it is rarely enough on its own. Whether it needs an apostille depends on the country and on what you are using it for. Where an apostille is needed, the certificate is first authenticated by the Maharashtra government and then apostilled by the Ministry of External Affairs (MEA). The visa officers in the US, UK, Canada and Australia also look past the certificate. They want proof that the marriage is genuine, and documents whose names, dates and translations match.
This guide covers getting the certificate ready, how the apostille works and what each of the four most common countries checks. It also covers the mistakes that most often delay or sink a spouse visa file. Immigration rules change often. Treat the official links below as the final word and this page as a map.
Step one: the right marriage certificate
Everything rests on a properly registered marriage. In Maharashtra, marriages performed with religious rites are registered under the Maharashtra Regulation of Marriage Bureaus and Registration of Marriages Act, 1998, with the local Registrar of Marriages. A civil marriage gets its certificate from the Marriage Officer under the Special Marriage Act, 1954. Our guide to marriage registration in Maharashtra explains both routes.
Before you go any further, check the certificate line by line:
- Names exactly as in the passports. "Snehal Prakash Jadhav" on the certificate and "Snehal Jadhav" in the passport is the kind of gap that gets questions. If the bride has changed her surname, the file must show the link between the old name and the new one.
- Dates of birth and the wedding date match every other document in the file.
- The language. Many certificates in Maharashtra are partly or fully in Marathi. US, UK, Canadian and Australian authorities all want an English translation of any document not in English, and they have their own rules about who may certify it.
- Spare copies. Ask the Registrar for extra certified copies and keep scans. You may need one for the visa, one for the apostille and one for later.
Apostille or attestation: which one do you need?
An apostille is a certificate attached to a public document so that it is accepted in other countries that belong to the 1961 Hague Apostille Convention. India is a member. The United States, the United Kingdom, Canada and Australia are also members. For these countries an apostille replaces the older chain of embassy legalisation.
Countries that are not members, including several Gulf states, still use attestation. MEA attests the document first, and then that country's embassy legalises it. If the keyword you searched was "marriage certificate attestation for UAE", that is the route you are on, not the apostille.
Do spouse visas in the US, UK, Canada or Australia need an apostille? None of the official spouse visa pages we checked for these four countries lists an apostille as a standard requirement for a spouse or partner visa. Apostilles come up more often when the certificate is used for something else abroad. Examples are registering the marriage with a foreign civil registry, a change of name in that country, or visas for countries whose checklists ask for one. Read your exact checklist before paying anyone. Many families spend money on an apostille the visa never needed.
How to get a marriage certificate apostilled from Maharashtra
The apostille is issued by MEA's Consular, Passport and Visa Division. MEA apostilles a document only after the state that issued it has verified it, so the process has two stages.
- State authentication. The Government of Maharashtra first verifies that your certificate was really issued by the Registrar or Marriage Officer named on it. For personal documents such as marriage certificates this is done by the state government department that MEA's apostille page names for Maharashtra. Offices, counters and appointment systems change from time to time, so confirm the current office on that page before you travel to Mumbai.
- MEA apostille. Submit the state-verified certificate to MEA, either at its own counter or through one of the outsourced collection agencies MEA authorises in several cities. The apostille is affixed to the document itself.
A few practical rules:
- Use only agencies listed on MEA's own website. Many private agents advertise "apostille in 2 days". Some are genuine intermediaries and some are not, and you would be handing over an original government document.
- Ask for the fee break-up in writing. MEA's own fee is separate from the service charge of the collection agency and from any courier charge.
- Apostille the right document. The apostille certifies the document it is attached to. If the foreign authority wants the translation apostilled as well, ask how the translation itself must be certified first.
What spouse visas look for, country by country
The details below are deliberately high level and were checked against official pages in October 2026. Fees, income thresholds and processing times change. Follow the official link for your country before you file.
United States
A US citizen or green-card holder files Form I-130 with USCIS. USCIS asks for a copy of the civil marriage certificate, proof that any earlier marriage of either spouse ended, and evidence of every legal name change. It also asks for evidence that the marriage is bona fide: joint property or a joint lease, combined finances, children born to the couple, or sworn affidavits from people who know the marriage. Foreign-language documents need a full English translation with the translator's certificate. If the couple has been married for less than two years when the spouse gets permanent residence, that residence is conditional, and the couple later apply together to remove the conditions. United Kingdom
For the family visa as a spouse or partner, you must show a marriage that is recognised in the UK and that you intend to live together permanently in the UK. There is also a financial requirement: most new applicants must show a combined income of at least £29,000 a year. There is an English language requirement too. Applications from outside the UK usually get a decision within 12 weeks. Official page: GOV.UK, family visa: apply as a partner or spouse
Canada
A Canadian citizen or permanent resident can sponsor a spouse who is legally married to them. The relationship must be genuine and not entered into only to gain permanent residence. The sponsor must also meet their own eligibility rules. IRCC's document checklist for the application lists the proof of marriage and of the relationship that it wants. Official page: IRCC, sponsor your spouse, partner or children
Australia
Partner visas are subclass 309/100 if you apply from outside Australia and 820/801 if you apply onshore. For a married couple, the Department of Home Affairs looks for a mutual commitment to a shared life as a married couple to the exclusion of all others, and a relationship that is genuine and continuing. You must also live together, or not live separately and apart on a permanent basis. Official page: Home Affairs, partner visa (offshore)
Common reasons spouse visas are delayed or refused
No official body publishes one list of rejection reasons for Indian spouse applications. The problems below come straight from what these four countries say they check, and they are the ones that most often send a file back.
- Name mismatches. Different spellings across the certificate, passports, Aadhaar and the application. A surname changed after marriage with no document showing the old and new names together.
- Weak evidence that the relationship is genuine. A certificate alone, with no photographs, communication history, visits or joint finances. This matters most for arranged marriages where the couple spent little time together before the wedding. In that case, explain how the match was made and show the contact since.
- Gaps in the history. A previous marriage of either spouse without the divorce decree or death certificate that ended it.
- Untranslated or poorly translated documents. A Marathi certificate sent with no translation, or with a translation that does not meet the country's rules.
- Money and sponsor requirements not met. This is especially relevant for the UK income threshold and the sponsor's own eligibility in Canada.
- Inconsistent dates. The wedding date on the invitation, the photographs, the certificate and the application should all agree. A late registration is fine. An unexplained clash of dates is not.
- Paying for the wrong document. An apostille the visa never asked for, while the translation it did ask for was skipped.
If a refusal letter arrives, read the stated reasons carefully. Most refusals name exactly what was missing. Fix those points before you apply again. For an appeal or a complicated history, speak to a regulated immigration adviser in the destination country.
Frequently asked questions
Is an Indian marriage certificate valid abroad? A marriage validly performed and registered in India is generally recognised abroad. However, each country decides recognition and immigration requirements under its own law. The certificate is the starting point, not the whole file.
Do I need an apostille on my marriage certificate for a spouse visa? Often not for the US, UK, Canada or Australia, whose spouse visa pages ask for the certificate and an English translation. Many other uses abroad and some other countries do ask for one. Your destination's checklist decides.
Can I get the apostille done online? Not end to end. A marriage certificate first needs authentication by the Maharashtra government, and only then goes to MEA. Check MEA's apostille page for which parts can be applied for or tracked online at present.
We had a religious wedding but never registered it. Is that a problem? Yes. Register it before you apply. A late registration with the local Registrar is still possible in Maharashtra, usually with a small penalty. It is far easier than explaining an unregistered marriage to a visa officer.
Should we add the spouse's name to the passport? It is not required for these four countries' spouse visas, but some families find it useful. Passport Seva accepts the marriage certificate or an Annexure J joint photo declaration for adding a spouse's name.
