Two questions come up together after many weddings: how a civil marriage works under the Special Marriage Act, and how to change your name on your documents once you are married. The short answers: a Special Marriage Act wedding in Maharashtra starts with an online notice to the Marriage Officer and takes at least 30 days; and changing your name after marriage is optional, but if you do it, update Aadhaar first, then PAN, then your passport, using the marriage certificate as proof.
The Special Marriage Act Explained: A Guide for Maharashtra (2026)
For inter-caste, inter-faith or non-religious couples in Maharashtra, the Special Marriage Act, 1954 lets you marry without either partner converting and without religious rites. In Maharashtra the Marriage Officers belong to the Registration and Stamps department (IGR), and the notice can be filed online on the IGR's eMarriage portal.
Eligibility (section 4): the groom must be 21 or older and the bride 18 or older; neither may have a living spouse; both must be able to give valid consent; and they must not be within the prohibited degrees of relationship unless a custom governing them allows it. At least one partner must have lived in the district for 30 days before the notice (section 5).
The process:
- Online notice. Fill in the notice of intended marriage on the IGR portal with both partners' and three witnesses' details, verify identity through Aadhaar, and upload age and address proof. The Marriage Officer checks it and asks you to pay the fee online (₹50 for the notice under the current fee table).
- 30-day notice period. The notice is published at the Marriage Officer's office, and anyone may object within 30 days on the grounds the Act recognises. Family disapproval is not one of them.
- Solemnisation. After 30 days, and within three months of the notice, you and three witnesses sign the declaration before the Marriage Officer, the marriage is solemnised, and the certificate is entered (₹150 in the office, ₹1,000 at another place).

How to Change Your Name After Marriage in India (2026 Guide)
No law requires anyone to change their name after marriage. Many women keep their own surname, some add their husband's, some change it fully. If you do change it, the aim is one name, spelt identically, on every document. Get your marriage certificate first; every office below accepts it as the proof of the change.
1. Aadhaar card
UIDAI's list of documents accepted for an update includes a marriage certificate issued by the Central or State Government. If the certificate has no photograph, carry an ID with your old name and photo as well. Name updates are usually done at an Aadhaar enrolment or update centre with biometric authentication; check the myAadhaar portal or the Aadhaar app to see whether your update can be done online. UIDAI limits how many times a name can be updated, so make the change once and spell it exactly as you want it everywhere else. If you are changing your first name or your whole name, UIDAI asks for a gazette notification instead.
2. PAN card
On the Protean (NSDL) or UTIITSL website, choose "Changes or Correction in existing PAN Data". The application uses Aadhaar e-KYC, and the name printed on the PAN is taken as it appears on Aadhaar, which is why Aadhaar comes first. The fee is shown before you pay and depends on whether you want a physical card.
3. Passport
A name change needs a re-issue of passport with a change in personal particulars, applied for on the Passport Seva portal and completed at a Passport Seva Kendra or Post Office Passport Seva Kendra. Carry your old passport and your marriage certificate. Passport rules have also accepted a joint declaration by the couple with a photograph (Annexure J) in place of a marriage certificate for adding a spouse's name; check the current document list on Passport Seva before your appointment.
4. Everything else
- Bank accounts and investments: submit the marriage certificate and updated Aadhaar and PAN at each bank, and to your demat and mutual fund KYC.
- Voter ID: apply for a correction of entries on the Election Commission's voter portal.
- Employer, provident fund, insurance and property records: update these last, once your Aadhaar and PAN carry the new name.
When you need a gazette notification
A marriage certificate is enough for a change of surname that follows from the marriage. For a new first name, a full change of name, or anything the certificate does not show, publish the change in the Maharashtra Government Gazette. The Directorate of Government Printing, Stationery and Publications takes applications online on its site, dgps.maharashtra.gov.in, and the change appears in Part II of the Gazette.
Frequently asked questions
Is it compulsory to change my surname after marriage? No. It is your choice. What matters is that your documents agree with each other, whichever name you use.
Which document should I update first? Aadhaar, because the PAN e-KYC route takes your name from Aadhaar, and banks and employers will ask for both.
Is the marriage certificate enough, or do I need a gazette? For taking your spouse's surname, the marriage certificate is normally enough. For a new first name or a completely different name, get a gazette notification.
Can I change my name under the Special Marriage Act itself? The Act registers the marriage; it does not change names. The certificate records your names as they are, and you then use it to update your documents.
This post is general information, not legal advice. Portals, fees and accepted documents change; check the current rules with the Marriage Officer, UIDAI, the PAN service provider and Passport Seva before you apply.
